YOUNG & Associates Prepares for NASP 2023

YOUNG & Associates is excited to sponsor the 25th Annual National Association of Subrogation Professionals (“NASP”) conference scheduled for November 5-8, 2023 at The Broadmoor in Colorado Springs, CO. In addition to sponsoring the conference, YOUNG & Associates is proud to have its experts sharing their specialized industry knowledge during four conference presentations. The NASP conference will provide a variety of subrogation-related education courses and present a fantastic opportunity to network with industry leaders, innovators, and experts.

Knowledge Sharing: We believe in sharing knowledge and insights with the community. The YOUNG & Associates team will present during four engaging sessions while at the NASP conference. Whether you’re a seasoned subrogation professional or just starting your journey in subrogation, the following educational sessions presented by the YOUNG & Associates experts will have something for everyone:

  • Senior Forensic Engineer Jeff Bonsall, a member of YOUNG & Associates’ accident reconstruction team, will present with Gibson Robb & Lindh attorneys Joshua Kirsch and Joey Ou during the session titled “Motor Truck Cargo Losses: The Secret Sauce to Maximize Recovery Potential.” Jeff, Joshua, and Joey will explore common causes of cargo damage and loss, such as improper load securement, insufficient maintenance of truck and trailer, load shifting, and operator error. The presentation will discuss how electronic data recorders, dash camera systems, and scene documentation can enhance recovery opportunities against potentially responsible third parties for the transportation industry. Key issues to be discussed include identification of potentially responsible third parties, deadlines for written notice of claims, statutes of limitations, limitations of liability, establishing a prima facie case, and addressing common defenses associated with inland marine claims.
  • Partner Camden Henderson, PhD, a member of YOUNG & Associates equipment services team, will present with Cozen O’Connor attorney Rick Maleski during the session titled “Elevator Claims: Pressing the Right Investigative Buttons to Ensure that Your Recovery Efforts Only Go Up.” Camden and Rick will discuss the types of elevators, elevator components, and the damages elevators often sustain. The presentation will explore the difference between loss-related damage and normal wear and tear; highlight the source of damages; and examine repair versus replacement valuations.
  • Senior Managing Engineer George Van Horne, PE, a member of YOUNG & Associates’ mechanical engineering team, will present with Cozen O’Connor attorney David Terry during the session titled “Freeze Failures and Subrogation Opportunities.” There are more subrogation opportunities presented by freeze failures than some insurance professionals realize. Severe weather is not necessarily an “Act of God” which automatically absolves third parties of consequences. This presentation will discuss why pipes in plumbing, sprinkler, and HVAC systems can freeze and cause damage – and explore how to recognize if such failures might be the legal responsibility of a third party.
  • Senior Managing Engineer David Transue, PE, a member of YOUNG & Associates’ civil / structural engineering team, will present with Stutman Law attorneys Tom Underwood during the session titled “Building Codes – More Than Mere Guidelines: How a Better Understanding of the Building Codes Applicable to your Specific Loss Can Lead to Improved Recovery Potential.” David and Tom will discuss how a better understanding of applicable building codes can improve your recovery potential. If construction fails to comply with the code requirements, contractors, developers, and designers may be potentially responsible. This presentation will introduce various codes and explore both industry standards of care and construction contractual requirements. David and Tom will also discuss the all-important “Authority Having Jurisdiction.”

The NASP conference will present a variety of educational sessions falling into seven tracks: 1) general subrogation, 2) subrogation fundamentals, 3) property subrogation, 4) auto subrogation, 5) workers’ compensation subrogation, 6) products liability, and 7) management seminars. YOUNG & Associates’ Director of Litigation Support Services Jeremy Jones, Esq. was selected to lead the management track presentations. Jeremy assisted the various management track speakers with the development of their presentations, and, during the conference, he will assist with the coordination of the various sessions.
